This information will assist Branch Officials in the running of their branch and ensure member rights are upheld. 

Dispute Resolution
Dispute Resolution is about trying to resolve problems as close to the source as possible.  Effective utilisation of the branch structure is important and following the steps outlined in the Dispute / Grievance Settlement Procedure in the Award will assist.

Commencing in 2008 motions from Braches are published below following consideration by your Association's Executive.  Some motions may not appear based on legal advice as their publication could expose your Association or its members to criminal or civil proceedings.

Intimidation of Members Not to Claim Entitlements

Members are often intimidated into taking a particular option when the industrial agreement specifically prescribes a choice of entitlement.

This is often due to budgets. Outlined below are some particular situations which offer such a choice, but it is emphasised that these are your choices, not those of the Officer in Charge and you have a legal right to chose whichever you prefer.

For instance it is your choice to take either a day in lieu or to be paid a minimum of eight (8) hours at time and a half when recalled from annual or extended leave. You cannot be compelled or intimidated to take time off in lieu of payment for overtime or travelling time payments.

When recalled on a rest day, it is again your choice to either elect to be paid for a minimum of three hours at overtime rates or be rostered to begin a normal flexible shift from the time of recall, payable at overtime rates. Neither option entitles you to an extra or alternative rest day.

The Industrial Agreement stipulates your entitlements and is legally enforceable. Should you be denied your entitlements or be intimidated in any way into taking one of your options over another, first contact your Branch Administrator and then the Association's head office in accordance with agreed Dispute Avoidance Procedures
